2. მინისტრმა 2026 წლის 1 იანვრამდე დაამტკიცოს „საქართველოს გარემოს დაცვისა და სოფლის მეურნეობის სამინისტროს საჯარო სამართლის იურიდიული პირის − ბირთვული და რადიაციული უსაფრთხოების სააგენტოს მიერ ადმინისტრაციული სამართალდარღვევის საქმის წარმოებისათვის საჭირო დოკუმენტების (მათ შორის, საჯარიმო ქვითრისა და სააღსრულებო ფურცლის) ფორმების, მათი შევსების, ჩაბარების, წარდგენის, გამოყენებისა და აღრიცხვა-ანგარიშგების წესები“.
2. By 1 January 2026, the Minister must approve “The Rules for the Forms of Documents (including Penalty Receipts and Enforcement Notices) Required for the Conduct of Administrative Offence cases by the Agency of Nuclear and Radiation Safety, a Legal Entity of Public Law within the Ministry of Environmental Protection and Agriculture of Georgia, and Their Completion, Submission, Presentation, Use and Accounting-Reporting”.

3. ამ კანონის ამოქმედების შემდეგ ახალი, შესაბამისი კანონქვემდებარე ნორმატიული აქტების მიღებამდე ძალაში დარჩეს „ბირთვული და რადიაციული უსაფრთხოების შესახებ“ საქართველოს კანონის შესაბამისად მიღებული კანონქვემდებარე ნორმატიული აქტები.
3. After the entry into force of this Law, normative acts adopted in accordance with the Law of Georgia on Nuclear and Radiation Safety shall remain in force until the adoption of new relevant normative acts.

Article 691 - Temporary rules for the implementation of activities defined by the licence for nuclear and radiation activities, the inspection of such activities, the application of coercive measures, as well as the issuance of permits for the export/import/transit of radioactive materials and related permits in case of export/import of nuclear materials, effective until 1 January 2026

1. ლიცენზიის მფლობელი ლიცენზიით განსაზღვრული საქმიანობის განხორციელებისას ვალდებულია შეასრულოს შემდეგი სალიცენზიო პირობები:
1. When carrying out activities defined by the licence, the licence holder shall be obliged to comply with the following licence conditions:

ა) უზრუნველყოს ბირთვული და რადიაციული უსაფრთხოება, ფიზიკური დაცვა და ბირთვული ან რადიოლოგიური საგანგებო სიტუაციისთვის მზადყოფნა;
a) ensure nuclear and radiation safety, physical protection, and preparedness for a nuclear or radiological emergency;

ბ) თანამედროვე ტექნიკური და სამეცნიერო დონის გათვალისწინებით, სისტემატურად შეაფასოს რადიაციული დაცვა, ბირთვული უსაფრთხოება და დაცულობა და პრაქტიკაში დანერგოს ამ შეფასების შედეგები;
b) systematically assess radiation protection, nuclear safety and security, taking into account the current technical and scientific level, and implement the results of this assessment in practice;

დასხივების დასაშვები დონის გადაჭარბების შემთხვევაში ჩაატაროს მოკვლევა და მისი შედეგები წერილობით აცნობოს მარეგულირებელ ორგანოს;
in case of exceeding the permissible radiation level, conduct an investigation and notify the Regulatory Authority in writing of its results;

დ) მარეგულირებელ ორგანოს წერილობით შეატყობინოს თავის საქმიანობასთან დაკავშირებული ნებისმიერი ცვლილების ან ამ საქმიანობის გაფართოების შესახებ და წარუდგინოს აღნიშნულ ცვლილებასთან/გაფართოებასთან დაკავშირებული დოკუმენტაცია და განახლებული რადიაციული დაცვის პროგრამა;
d) notify the Regulatory Authority in writing of any changes related to its activities or the expansion of these activities, and provide documentation related to these changes/expansion and an updated radiation protection programme;

ე) მაიონებელი გამოსხივების წყაროსთან მოპყრობის ყველა ეტაპზე შეასრულოს იმ რადიაციული დაცვის პროგრამით განსაზღვრული ვალდებულებები, რომელიც მოიცავს ხარისხის უზრუნველყოფისა და მონიტორინგის პროგრამებს და რეაგირების გეგმას;
e) comply with the obligations specified in the radiation protection programme at all stages of ionising radiation source management, including quality assurance and monitoring programmes, as well as a response plan;

ვ) დაიცვას ადმინისტრაციული და ტექნოლოგიური პირობებით განსაზღვრული გაზომვების ჩატარებისა და გამზომი ხელსაწყოების უნიფიცირების მოთხოვნები;
f) comply with the requirements for conducting measurements and unifying measuring instruments specified by administrative and technological conditions;

ზ) მიიღოს მაიონებელი გამოსხივების მხოლოდ ისეთი წყარო, რომელსაც თან ახლავს შესაბამისი დოკუმენტაცია, აქვს ნიშნული და რომელიც მოთავსებულია სათანადო მარკირების მქონე შეფუთვაში − დამცავ კონტეინერში;
g) accept only such sources of ionising radiation that are accompanied by appropriate documentation, are labelled and placed in a properly labelled packaging – a protective container;

თ) მაიონებელი გამოსხივების წყაროსა და რადიოაქტიურ ნარჩენებთან მუშაობის უფლება მიანიჭოს მხოლოდ იმ პირებს, რომლებსაც აქვთ სპეციალური პროფესიული ცოდნა, აკმაყოფილებენ საქართველოს კანონმდებლობით დადგენილ პირობებს და შესაბამისი საქმიანობის განხორციელებისთვის სამედიცინო უკუჩვენება არ აქვთ;
h) grant the right to work with ionising radiation sources and radioactive waste only to persons with special professional knowledge, who meet the conditions established by the legislation of Georgia and who do not have medical contraindications for carrying out the relevant activity;

ი) მარეგულირებელ ორგანოს დაუყოვნებლივ შეატყობინოს ტექნოლოგიურ პროცესში მომხდარი გადახრის, აგრეთვე ფიზიკური დაცვის პირობების ან/და ავარიებისთვის მზადყოფნის პირობების დარღვევის შესახებ, რომლებიც მნიშვნელოვანია რადიაციული დაცვისთვის, ბირთვული უსაფრთხოებისა და დაცულობისთვის;
i) immediately notify the Regulatory Authority of any deviations in the technological process, as well as violations of physical protection and/or emergency preparedness conditions that are important for radiation protection, nuclear safety and security;

ამ მიზნით ლიცენზიის მფლობელმა უნდა განახორციელოს აღნიშნული ობიექტის სათანადო გამოკვლევა და მონიტორინგი და უნდა უზრუნველყოს მარეგულირებელი ორგანოსთვის შესაბამისი შეტყობინების გაგზავნა;
To do this, a licence holder must conduct an appropriate inspection and monitoring of the facility and ensure that the appropriate notification is sent to the Regulatory Authority;

უ) შეასრულოს მარეგულირებელი ორგანოს მიერ ადამიანის ჯანმრთელობასა და გარემოზე მავნე ზემოქმედების თავიდან აცილების, რადიაციული უსაფრთხოებისა და ფიზიკური დაცვის უზრუნველსაყოფად დადგენილი ყველა მოთხოვნა;
t) comply with all requirements established by the Regulatory Authority to prevent harmful effects on human health and the environment, ensure radiation safety and physical protection;

ფ) მაღალი რადიაციული რისკის მქონე საქმიანობის განხორციელებისას მარეგულირებელი ორგანოს მოთხოვნის შემთხვევაში შეაფასოს ამ საქმიანობის უსაფრთხოება და შესაბამისი ანგარიში წარუდგინოს მარეგულირებელ ორგანოს;
u) when carrying out activities with a high radiation risk, at the request of the Regulatory Authority, assess the safety of such activity and submit an appropriate report to the Regulatory Authority;
