ეს კანონი არ ვრცელდება რეგულირებიდან გამორიცხულ ბირთვულ და რადიაციულ საქმიანობასა და რადიოაქტიურ წყაროზე, რომლის დონეები დგინდება საქართველოს კანონმდებლობით.
This Law shall not apply to nuclear and radiation activities, as well as to radioactive sources excluded from regulation, the levels of which are established by the legislation of Georgia.

აკრძალულია ნებისმიერი ქმედება, რომელიც უკავშირდება ბირთვული იარაღისა და ბირთვული მასალის შემცველი სხვა ასაფეთქებელი მოწყობილობების დამზადებას, ფლობასა და გადაცემას, ამ იარაღისა და მოწყობილობების პირდაპირ ან არაპირდაპირ კონტროლს, მათ შესაქმნელად სხვა ქვეყნებთან თანამშრომლობას, ასევე ბირთვული ან სხვა რადიოაქტიური მასალის არამშვიდობიანი მიზნით გამოყენებას.
Any activity related to the production, storage and transfer of nuclear weapons and other explosive devices containing nuclear material, direct or indirect control over these weapons and devices, cooperation with other countries in their creation, as well as the use of nuclear or other radioactive material for non-peaceful purposes shall be prohibited.

ამ მუხლის პირველი პუნქტით გათვალისწინებული ქმედება იწვევს საქართველოს კანონით განსაზღვრულ შესაბამის პასუხისმგებლობას.

ა) რადიაციული დაცვის, ბირთვული უსაფრთხოებისა და დაცულობის ეროვნული პოლიტიკის განსაზღვრა.
a) defining national policies in the field of radiation protection, nuclear safety and security.

ბ) საჯარო სამართლის იურიდიული პირის − ბირთვული და რადიაციული უსაფრთხოების სააგენტოს (შემდგომ − ორგანო) ფუნქციების განსაზღვრა მაიონებელი გამოსხივების წყაროს მშვიდობიანი მიზნით გამოყენებაზე მარეგულირებელი კონტროლის განსახორციელებლად.
b) defining the functions of a legal entity under public law - the Agency of Nuclear and Radiation Safety (hereinafter - the Regulatory Authority), to carry out regulatory control over the use of ionising radiation sources for peaceful purposes.

ა) ავტორიზაცია – ადმინისტრაციული წარმოების ფარგლებში მარეგულირებელი ორგანოს მიერ პირისთვის ბირთვული და რადიაციული საქმიანობის განხორციელების უფლების მინიჭება, რეგისტრაციის, ლიცენზიის ან/და ნებართვის სახით.
a) authorization - granting a person the right to carry out nuclear and radiation activities by a Regulatory Authority within the framework of administrative proceedings in the form of registration, licence and/or permit.

ბ) ბირთვული ან რადიოლოგიური საგანგებო სიტუაცია − ცალკეულ ტერიტორიებზე ან ორგანიზაციებში,ჯაჭვური რეაქციის დროს ან მის შედეგად წარმოქმნილი პროდუქტების დაშლისას გამოთავისუფლებული ენერგიით, რადიაციული დასხივებით ან ამგვარი დასხივების რისკით გამოწვეული ისეთი კრიზისული ვითარება, რომელიც საფრთხეს უქმნის ან/და შეიძლება შეუქმნას პერსონალის ან მოსახლეობის სიცოცხლეს ან/და ჯანმრთელობას, იწვევს ან შეიძლება გამოიწვიოს მსხვერპლი, ადამიანთა დაშავება ან/და მნიშვნელოვანი მატერიალური ზიანი ან/და გარემოს რადიოაქტიური დაბინძურება.
b) nuclear or radiological emergency - a crisis situation caused by energy released during a chain reaction or the decay of products resulting from it, radiation exposure or the risk of such exposure in certain territories or organisations, which poses and/or may pose a threat to the life and/or health of personnel or the public, causes or may cause casualties, human injuries and/or significant tangible damage and/or radioactive pollution of the environment.

გ) ბირთვული გაუვრცელებლობის გარანტიები − ვალდებულებათა სისტემა, რომელიც ეფუძნება ატომური ენერგიის საერთაშორისო სააგენტოსა და მის წევრ ქვეყნებს შორის დადებულ შეთანხმებას.
c) nuclear non-proliferation guarantees - a system of obligations based on the agreement concluded between the International Atomic Energy Agency and its Member States.

დ) ბირთვული და რადიაციული ობიექტი − ობიექტი (ნაგებობისა და აღჭურვილობის ჩათვლით), სადაც ხორციელდება მაიონებელი გამოსხივების წყაროსთან მოპყრობა.
d) nuclear and radiation facility - an object (including buildings and equipment) where a source of ionising radiation is handled.

ე) ბირთვული დაცულობა − ბირთვულ მასალასთან, სხვა რადიოაქტიურ მასალასთან, ასოცირებულ ობიექტთან ან ასოცირებულ საქმიანობასთან დაკავშირებული სისხლისსამართლებრივი ან განზრახ უკანონო ქმედებების პრევენცია, დეტექტირება და ამ ქმედებებზე რეაგირება.
e) nuclear safety - prevention, detection and response to criminal or intentional unlawful acts related to nuclear materials, other radioactive materials, related facilities or related activities.

ვ) ბირთვული დაცულობის კულტურა − მახასიათებლების, დამოკიდებულებისა და ქცევის ერთობლიობა, რომელიც ხელს უწყობს და უზრუნველყოფს ბირთვული დაცულობის მდგრადობას.
f) nuclear safety culture - a set of characteristics, attitudes, and behaviours that promote and ensure the sustainability of nuclear safety.

ზ) ბირთვული დაცულობის სისტემა − სამართლებრივი, კვლევითი და საინჟინრო ღონისძიებების ერთობლიობა, რომლის მიზანია ბირთვული ტერორიზმის, ბირთვული და რადიოაქტიური მასალების დატაცების ან მათთან არაკანონიერი მოპყრობის პრევენცია.
g) nuclear safety system - a set of legal, research and engineering measures aimed at preventing nuclear terrorism, theft or illegal handling of nuclear and radioactive materials.

თ) ბირთვული უსაფრთხოება − ოპერირების სათანადო პირობები, ბირთვული ან რადიოლოგიური საგანგებო სიტუაციის პრევენცია და ამ სიტუაციის შედეგების მიტიგაცია საქართველოს კანონმდებლობის შესაბამისად, რის შედეგადაც ხორციელდება არასათანადო რადიაციული რისკისგან პერსონალის, მოსახლეობისა და გარემოს დაცვა.
h) nuclear safety - appropriate operating conditions, prevention of nuclear or radiological emergencies and mitigation of the consequences of such situations in accordance with the legislation of Georgia, as a result of which personnel, the public and the environment are protected against excessive radiation risk.

ი) ბირთვული უსაფრთხოების კულტურა − მახასიათებლებისა და დამოკიდებულების ერთობლიობა, რომლითაც რადიაციული დაცვისა და ბირთვული უსაფრთხოების საკითხები განსაზღვრულია პრიორიტეტულად და მათ პირის საქმიანობაში სათანადო ყურადღება ენიჭება.
i) nuclear safety culture - a set of characteristics and attitudes that identify radiation protection and nuclear safety issues as a priority and give them due attention in a person’s activities.
