An applicant for a nuclear and radiation activity licence for the operation of a nuclear and radiation facility shall submit to the Regulatory Authority for approval an initial decommissioning plan, which must be developed taking into account the type, condition and risks inherent in its decommissioning.

The holder of a nuclear and radiation activity licence shall update the decommissioning plan every 10 years and/or upon a substantiated request from the Regulatory Authority.

If existing circumstances have led to the need to make significant changes to the initial decommissioning plan, the holder of the nuclear and radiation activity licence shall be required to amend and update the decommissioning plan to reflect the changed circumstances and submit it to the Regulatory Authority for approval.

The Regulatory Authority shall ensure that a monitoring and implementation program is in place to meet applicable requirements at facilities where further use of the facility after decommissioning remains limited.

Upon completion of decommissioning, the Regulatory Authority must ensure that reports confirming completed decommissioning activities are properly stored in accordance with the decommissioning plan agreed with it.
