„ბირთვული იარაღის გაუვრცელებლობის შესახებ ხელშეკრულებასთან დაკავშირებით გარანტიების გამოყენების თაობაზე“ საქართველოს რესპუბლიკისა და ატომური ენერგიის საერთაშორისო სააგენტოს შეთანხმებისა (შემდგომ − შეთანხმება) და ამ შეთანხმების დამატებითი ოქმის (შემდგომ − დამატებითი ოქმი) შესაბამისად, მარეგულირებელი ორგანო უფლებამოსილია გააკონტროლოს ბირთვული იარაღისა და მასალის, აგრეთვე ატომური იარაღის წარმოებისთვის აღჭურვილობის გაუვრცელებლობის თაობაზე საქართველოს მიერ მიღებული გარანტიების იმპლემენტაცია.
In accordance with the Agreement between the Republic of Georgia and the International Atomic Energy Agency for the Application of Safeguards in Connection with the Treaty on the Non-proliferation of Nuclear Weapons (hereinafter - the Agreement) and the Additional Protocol to this Agreement (hereinafter - the Additional Protocol), the Regulatory Authority shall be authorised to monitor the implementation of guarantees adopted by Georgia regarding the non-proliferation of nuclear weapons and materials, as well as equipment for the production of nuclear weapons.

ა) საქართველოს კანონმდებლობით განსაზღვრულ სტრუქტურებსა და უწყებებთან კოორდინაცია ატომური ენერგიის საერთაშორისო სააგენტოსათვის შეთანხმებითა და დამატებითი ოქმით განსაზღვრული ინფორმაციის მისაწოდებლად;
a) coordination with the structures and institutions specified in the legislation of Georgia to provide the International Atomic Energy Agency with the information specified in the Agreement and the Additional Protocol;

ბ) შეთანხმებისა და დამატებითი ოქმის მოთხოვნების შესასრულებლად აუცილებელი ინფორმაციის შეგროვება და ატომური ენერგიის საერთაშორისო სააგენტოსთვის დროულად მიწოდება;
b) collection of information necessary to comply with the requirements of the Agreement and the Additional Protocol, and timely provision thereof to the International Atomic Energy Agency;

გ) საქართველოში ატომური ენერგიის საერთაშორისო სააგენტოს ინსპექტორთა საქმიანობის განხორციელების, ასევე ინსპექტირების ადგილზე მათი შეუფერხებელი დაშვების ხელშეწყობა შეთანხმებისა და დამატებითი ოქმის მოთხოვნათა შესაბამისად;
c) facilitate the activities of inspectors of the International Atomic Energy Agency in Georgia, as well as their unhindered access to the place of inspections in accordance with the requirements of the Agreement and the Additional Protocol;

დ) ატომური ენერგიის საერთაშორისო სააგენტოს ინსპექტორთა საქმიანობის დაგეგმვის, განხორციელებისა და შეფასების მხარდაჭერა შეთანხმებისა და დამატებითი ოქმის მოთხოვნების შესასრულებლად;
d) support the planning, implementation and evaluation of the activities of inspectors of the International Atomic Energy Agency in order to comply with the requirements of the Agreement and the Additional Protocol;

ე) შეთანხმების ეფექტიანი იმპლემენტაციისათვის, საქართველოში ბირთვული მასალების აღრიცხვისა და კონტროლის სისტემის შექმნა და დანერგვა მინისტრის ბრძანების შესაბამისად.
e) for the effective implementation of the Agreement, the creation and implementation of a system for accounting and control of nuclear materials in Georgia in accordance with the order of the Minister.

დამატებითი ოქმის მოთხოვნების იმპლემენტაციის მიმართ მოთხოვნები განისაზღვრება ტექნიკური რეგლამენტით − „გარანტიების შეთანხმების დამატებითი ოქმის მოთხოვნების განხორციელების წესი“.
The requirements for meeting the requirements of the Additional Protocol shall be determined by Technical Regulations “Rules for Meeting the Requirements of the Additional Protocol to the Safeguards Agreement”.

შეთანხმებისა და დამატებითი ოქმის იმპლემენტაციის საკითხებზე ეროვნული პასუხისმგებელი პირი უნდა იყოს მარეგულირებელი ორგანოს უფლებამოსილი წარმომადგენელი, რომელსაც უფლება აქვს: ა) შეამოწმოს შეთანხმებისა და დამატებითი ოქმის მოთხოვნებით განსაზღვრული ობიექტი ან მისი ცალკეული ნაგებობა;
The national responsible person for the implementation of the Agreement and the Additional Protocol is an authorised representative of the Regulatory Authority, who has the right to: a) inspect the facility or its separate building specified in the requirements of the Agreement and the Additional Protocol;

d) carry out measurements and take samples from any location on the installation, facility or its separate building specified in the requirements of the Agreement and the Additional Protocol.

a) describe the physical and chemical properties of the nuclear material used in its activities;

ბ) აღრიცხოს ბირთვული მასალა, აწარმოოს ფიზიკური ინვენტარიზაცია და წარუდგინოს მარეგულირებელ ორგანოს ანგარიშები, საქართველოს კანონმდებლობის შესაბამისად;
b) register nuclear material, conduct physical inventory and submit reports to the Regulatory Authority in accordance with the legislation of Georgia;

გ) მარეგულირებელ ორგანოს მიაწოდოს ინფორმაცია ბირთვული მასალით საქმიანობასთან დაკავშირებული ნებისმიერი ცვლილების შესახებ, ორგანიზაციის საპროექტო დიზაინისა და სხვა მოსალოდნელი ცვლილების ჩათვლით;
c) provide the Regulatory Authority with information on any changes related to activities with nuclear materials, including organisational structure and other expected changes;

დ) უზრუნველყოს ბირთვული მასალის ფიზიკური დაცვა და უსაფრთხოების ზომების მიღება დადგენილი წესით;
d) ensure the physical protection of nuclear materials and take safety measures in the prescribed manner;
