The purpose of inspections of nuclear and radiation activities is to determine the conformity of the activities of an individual or legal entity with the requirements established by the legislation of Georgia in the fields of radiation protection, nuclear safety and security and to respond appropriately.

ა) ავტორიზებული პირის მიერ ბირთვული და რადიაციული საქმიანობის განხორციელებისას, სარეგისტრაციო ან/და სალიცენზიო პირობების ან/და შეზღუდვების შესრულების კონტროლი ან/და რადიაციული დაცვის, ბირთვული უსაფრთხოებისა და დაცულობის პირობების დარღვევის გამოვლენა;
a) monitoring compliance with the conditions of registration and/or licensing and/or restrictions by an authorised person in carrying out nuclear and radiation activities and/or detecting violations of the conditions of radiation protection, nuclear safety and security;

c) appropriate response in case of detection of violations of the requirements established by the legislation of Georgia in the field of radiation protection, nuclear safety and security.

The Regulatory Authority shall be authorised to inspect the facility in accordance with the legislation of Georgia in order to exercise state control.

An inspection of a facility may be carried out without prior notification to an authorised or unauthorised person, and the issuance of an individual administrative and legal act shall not be required.

მარეგულირებელი ორგანო უფლებამოსილია, მიიღოს იძულებითი ღონისძიებები საქართველოს კანონმდებლობის მოთხოვნების, სალიცენზიო, სანებართვო ან სარეგისტრაციო პირობების ან/და შეზღუდვების დარღვევის ან არაავტორიზებული ბირთვული და რადიაციული საქმიანობის აღმოჩენის შემთხვევაში.
The Regulatory Authority shall be authorised to take coercive measures in case of violation of the requirements of the legislation of Georgia, conditions and/or restrictions of licencing, permits or registration, as well as in case of detection of unauthorised nuclear and radiation activities.

საქართველოს კანონმდებლობის მოთხოვნების, სარეგისტრაციო ან სალიცენზიო, ან სანებართვო პირობის ან/და შეზღუდვების დარღვევის გამოვლენის შემთხვევაში მარეგულირებელი ორგანო ვალდებულია განახორციელოს საქართველოს ადმინისტრაციულ სამართალდარღვევათა კოდექსით გათვალისწინებული ქმედებები.
In case of detection of violations of the requirements of the legislation of Georgia, conditions and/or restrictions on registration, licensing or permits, the Regulatory Authority shall be obliged to take measures provided for by the Code of Administrative Offences of Georgia.

The Regulatory Authority shall set a reasonable time limit for the elimination of the detected violation and notify the violator in writing.

მარეგულირებელი ორგანო უფლებამოსილია რეგისტრაციის ან ლიცენზიის მფლობელს, რომლის საქმიანობამაც შეიძლება ზიანი მიაყენოს მოსახლეობას ან/და დააბინძუროს გარემო, დაუდგინოს დამატებითი პირობები/შეზღუდვები ან/და გაუუქმოს რეგისტრაცია ან/და ლიცენზია, საქართველოს კანონმდებლობის შესაბამისად.
The Regulatory Authority shall be authorised to establish additional conditions/restrictions and/or revoke the registration and/or licence of the holder of the registration or licence, whose activities may cause harm to the public and/or pollute the environment, in accordance with the legislation of Georgia.

მარეგულირებელი ორგანოს უფლებამოსილ თანამშრომელს აქვს საქართველოს ადმინისტრაციულ სამართალდარღვევათა კოდექსით გათვალისწინებულ ადმინისტრაციულ სამართალდარღვევათა საქმეების განხილვისა და ადმინისტრაციული სახდელების დადების უფლება.
An authorised employee of the Regulatory Authority shall have the right to consider cases of administrative offences provided for by the Code of Administrative Offences of Georgia and impose administrative sanctions.

ადმინისტრაციული სამართალდარღვევის საქმის წარმოებისათვის საჭირო დოკუმენტების (მათ შორის, საჯარიმო ქვითრის და სააღსრულებო ფურცლის) ფორმებს, მათი შევსების, ჩაბარების, წარდგენის, გამოყენებისა და აღრიცხვა-ანგარიშგების წესებს ამტკიცებს მინისტრი.
The forms of documents (including receipts of fines and a writ of execution) required for administrative offence proceedings, as well as the rules for their completion, presentation, use, accounting and reporting, shall be approved by the Minister.

თუ პირი რადიაციული დაცვის, ბირთვული უსაფრთხოებისა და დაცულობის სფეროებში საქმიანობას საქართველოს კანონმდებლობის დარღვევით ახორციელებს ან/და თუ ამ საქმიანობის შედეგად შეიძლება მყისიერი და უშუალო საფრთხე შეექმნას ადამიანის სიცოცხლეს ან ჯანმრთელობას, გარემოს ან შესაბამის მტკიცებულებებს, მარეგულირებელი ორგანოს ინსპექტორს უფლება აქვს, პირს დროებით შეუჩეროს საქმიანობა ამ ნაწილში (საჭიროების შემთხვევაში დალუქოს ობიექტი, დანადგარი, აგრეგატი, მოწყობილობა).
If a person carries out activities in the field of radiation protection, nuclear safety and security in violation of the legislation of Georgia and/or if such activities may pose an immediate and direct threat to human life or health, the environment or relevant evidence, an inspector of the Regulatory Authority shall have the right to temporarily suspend the person’s activities in this field (if necessary, seal the facility, equipment, installation, device).

მარეგულირებელი ორგანოს ინსპექტორს უფლება აქვს, მოსთხოვოს რეგისტრაციის ან/და ლიცენზიის მფლობელს იმ პერსონალის სამუშაოზე არდაშვება, რომლის კვალიფიკაცია ამ სამუშაოსთვის დადგენილ მოთხოვნებს არ შეესაბამება.
An inspector of the Regulatory Authority shall have the right to require a person who has a registration and/or licence to refuse to hire personnel whose qualifications do not meet the requirements established for this job.

ამ მუხლის პირველ პუნქტში აღნიშნულ შემთხვევებში რეგისტრაციის ან/და ლიცენზიის მფლობელი თავის მიერ განხორციელებული და შეჩერებული საქმიანობის შედეგად დარჩენილი რადიოაქტიური მასალების უსაფრთხოებისა და დაცულობის უზრუნველყოფის ვალდებულებისაგან არ თავისუფლდება.
In the cases specified in the first paragraph of this article, a person who has a registration and/or licence may not be exempt from the obligation to ensure the safety and security of radioactive materials remaining as a result of activities carried out and suspended by him/her.

მარეგულირებელი ორგანოს ინსპექტორი, იძულებითი ზომების განხორციელების მიზნით, ინსპექტირების მასალების, მათ შორის, ინსტრუმენტული გაზომვების, ტესტირების შედეგების, რეგისტრაციის ან/და ლიცენზიის მფლობელის ახსნა-განმარტებების და სხვა ინფორმაციის საფუძველზე ადგენს შესაბამის ოქმს, საქართველოს ადმინისტრაციულ სამართალდარღვევათა კოდექსის შესაბამისად.
In order to implement coercive measures, an inspector of the Regulatory Authority shall draw up an appropriate minute based on the inspection materials, including instrumental measurements, test results, explanations from the owner of registration and/or licence and other information, in accordance with the Code of Administrative Offences of Georgia.

„ტექნიკური რეგლამენტის − „მაიონებელი გამოსხივების წყაროებთან მოპყრობისადმი რადიაციული უსაფრთხოების ნორმებისა და ძირითადი მოთხოვნების“ დამტკიცების შესახებ“ საქართველოს მთავრობის დადგენილებით განისაზღვრება მოთხოვნები მაიონებელი გამოსხივებით გამოწვეული მავნე ზემოქმედებისგან ადამიანებისა და გარემოს დასაცავად, მათ შორის, ატომური ენერგიის საერთაშორისო სააგენტოს რეკომენდაციების გათვალისწინებით, დასხივების დოზური ზღვრები მარეგულირებელი ორგანოს კონტროლისადმი დაქვემდებარებული ბირთვული და რადიაციული საქმიანობის განმახორციელებელი პირებისათვის.
The Ordinance of the Government of Georgia on the Approval of the Technical Regulations “Standards of Radiation Safety and Basic Requirements for the Handling of Ionising Radiation Sources” shall define the requirements for the protection of people and the environment from the harmful effects of ionising radiation, including, taking into account the recommendations of the International Atomic Energy Agency, exposure dose limits for persons engaged in nuclear and radiation activities, subject to the control of the Regulatory Authority.
