2) “უნებართვოდ შესული და/ან მყოფი პირი” ნებისმიერი პირი, რომელიც არ ან აღარ აკმაყოფილებს შესვლისათვის ან ცხოვრებისათვის საჭირო პირობებს.

3) “რეადმისია”: პირის რეადმისია, რომელსაც დაუმტკიცდება ან დამაჯერებლად ივარაუდება, რომ მას გააჩნია ერთ-ერთი მხარის მოქალაქეობა და რომელიც არ ან აღარ აკმაყოფილებს მეორე მხარის ტერიტორიაზე შესვლის ან ყოფნის პირობებს.
3. “readmission”: the readmission of a person of whom it can be proven or plausibly demonstrated that he has the nationality of one of the Parties and who does not fulfil or no longer fulfils the conditions for entry or residence in the territory of one of the other Parties.

4) “იძულებით გადაცემა”: ერთ-ერთი მხარის ტერიტორიაზე იმ პირისათვის შესვლის ნებართვის მიცემა, რომელიც არის მესამე სახელმწიფოს მოქალაქე და რომელიც არ აკმაყოფილებს ერთ-ერთი მხარის ტერიტორიაზე შესვლის ან ყოფნის პირობებს, წინამდებარე შეთანხმებით გათვალისწინებული პირობების მიხედვით.
4. “reconduction”: admission into the territory of one of the Parties of a person who is a third State national and who does not fulfil or no longer fulfils the conditions for entry or residence in the territory of one of the other Parties, under the conditions set forth in this Agreement.

5ა) “საკუთარი მოქალაქე”: ნებისმიერი პირი, რომელსაც გააჩნია ბენელუქსის რომელიმე სახელმწიფოს ან საქართველოს მოქალაქეობა.

5ბ) საქართველოსათვის „nationality“ განსაზღვრულია, როგორც მოქალაქეობა, საქართველოს კანონმდებლობის შესაბამისად.
5b. For Georgia “nationality” is defined as citizenship in accordance with Georgian legislation.

6. “third State”: any State which is neither a State of the Benelux nor Georgia.

7) “მესამე სახელმწიფოს მოქალაქე”: ნებისმიერი პირი, რომელსაც არ გააჩნია ბენელუქსის რომელიმე სახელმწიფოს ან საქართველოს მოქალაქეობა.
7. “third State national”: anyone who does not have the nationality of one of the States of the Benelux or of Georgia, including stateless persons.

9) “მოთხოვნის წარმდგენი მხარე”: მხარე, რომლის ტერიტორიაზეც აღმოჩენილია პირი, რომელიც შემოსულია და/ან იმყოფება ნებართვის გარეშე და რომელიც ითხოვს ამ პირის რეადმისიას ან იძულებით გადაცემას ან მის ტრანზიტს, წინამდებარე შეთანხმებით გათვალისწინებული პირობების მიხედვით.
9. “requesting Party”: the Party on whose territory a person who has entered and/or is residing without authorisation is to be found and which requests the readmission or reconduction of this person or his transit, under the conditions set forth in this Agreement.

10) “მოთხოვნის მიმღები მხარე”: მხარე, რომელიც იღებს პირის რეადმისიის ან იძულებითი გადაცემის მოთხოვნას, ან მის ტერიტორიაზე ტრანზიტის ნებართვას, წინამდებარე შეთანხმებით გათვალისწინებული პირობების მიხედვით.
10. “requested Party”: the Party which is asked to readmit or reconduct a person who has entered and/or is residing without authorisation to its territory or to allow his transit over its territory, under the conditions set forth in this Agreement.

11) “ბინადრობის ნებართვა”: ერთ-ერთი მხარის მიერ გაცემული ნებართვა, მიუხედავად მისი ტიპისა, რომელიც პირს აძლევს მის ტერიტორიაზე ყოფნის უფლებას.
11. ”residence permit”: authorisation issued by one of the Parties, regardless of what type, which gives a person the right to stay on its territory.

1) თითოეული მხარე, მეორე მხარისაგან მოთხოვნის საფუძველზე ყოველგვარი ფორმალობის გარეშე, გარდა წინამდებარე შეთანხმებით გათვალისწინებულისა, მიიღებს თავის ტერიტორიაზე ნებისმიერ პირს, რომელიც არ ან აღარ აკმაყოფილებს მოთხოვნის წარმდგენი მხარის ტერიტორიაზე შესვლის ან ყოფნის პირობებს, თუ შესაძლებელია იმის დამტკიცება ან დამაჯერებლად ივარაუდება, რომ აღნიშნული პირი არის მოთხოვნის მიმღები მხარის მოქალაქე.
(1) Each Party shall readmit to its territory, at the request of the other Party, without any formalities other than those which are set forth in this Agreement, a person who does not fulfil or no longer fulfils the conditions for entry into or residence in the territory of the requesting Party, when it can be proven, or, there is a reasonable assumption, it can be plausibly demonstrated, that he has the nationality of the requested Party.

2) პირველ პუნქტში მოცემული რეადმისიის ვალდებულება ასევე ვრცელდება იმ პირზეც, რომელიც მოთხოვნის წარმდგენი მხარის ტერიტორიაზე შესვლის შემდეგ დაკარგავს მოთხოვნის მიმღები მხარის მოქალაქეობას და რომელსაც არ მიუღია სხვა სახელმწიფოს მოქალაქეობა ან მოთხოვნის წარმდგენი მხარის გარანტია მოქალაქეობის მინიჭების შესახებ .
(2) The readmission obligation in paragraph (1) also applies in the case of a person who, after entering the territory of the requesting Party, has lost the nationality of the requested Party, unless the person concerned has acquired the nationality of another state or received at least a naturalisation commitment from the requesting Party.

3) მოთხოვნის წარმდგენი მხარის მოთხოვნის საფუძველზე და მე-7 მუხლის მე-5 პუნქტის დებულებების შესაბამისად, მოთხოვნის მიმღებმა მხარემ დაუყოვნებლივ უნდა გასცეს რეადმისიას დაქვემდებარებული პირის უკან დაბრუნებისათვის საჭირო სამგზავრო დოკუმენტები.
(3) At the request of the requesting Party, and in accordance with the provisions of article 7, paragraph (5), the requested Party shall immediately issue the travel documents required for the return journey of the persons to be readmitted.

4) მოთხოვნის წარმდგენი მხარე განახორციელებს ასეთი პირის რეადმისიას იმავე პირობებში, თუ მოგვიანებით ჩატარებული შემოწმების შედეგად გამოაშკარავდება, რომ მოთხოვნის წარმდგენი ხელშემკვრელი მხარის ტერიტორიის დატოვების დროს ამ პირს არ გააჩნდა მოთხოვნის მიმღები მხარის მოქალაქეობა, თუ მე-2 პუნქტიდან არ გამომდინარეობის რეადმისიის ვალდებულება.
(4) The requesting Party shall readmit this person on the same conditions should it emerge from subsequent examination that at the time of leaving the territory of the requesting Party he did not have the nationality of the requested Party, unless the readmission obligation follows from paragraph (2).

1) თითოეული მხარე, მეორე მხარის მოთხოვნის საფუძველზე ყოველგვარი ფორმალობის გარეშე, გარდა წინამდებარე შეთანხმებით გათვალისწინებულისა, მოახდენს მის ტერიტორიაზე მყოფი მესამე სახელმწიფოს მოქალაქის იძულებით გადაცემას, რომელიც შევიდა უშუალოდ მოთხოვნის მიმღები სახელმწიფოს ტერიტორიიდან და არ აკმაყოფილებს მოთხოვნის წარმდგენი მხარის ტერიტორიაზე შესვლის ან ყოფნის პირობებს, და თუ შესაძლებელია იმის დამტკიცება ან დამაჯერებლად ივარაუდება, რომ ეს მოქალაქე:
(1) Each Party shall reconduct, at the request of the other Party and without any formalities other than those set forth in this Agreement, any third State national to its territory, who has entered therein immediately from the territory of the requested State, and who does not fulfil the conditions for entry into or residence in the territory of the requesting Party, and when it can be proven, or on the basis of a reasonable assumption it can be plausibly demonstrated, that this national:
