3. a. upon entering the territory of the requesting Party illegally, possessed a valid residence permit or a valid visa, other than a transit visa, issued by the requested Party, when its validity period exceeds the validity period of visa of the requested Party.

b. The requesting Party shall readmit this person should it emerge from subsequent examination that at the time of leaving the territory of the requesting Party he did not have the nationality of a country the requested Party has concluded a readmission agreement with.

c.The above provisions shall apply automatically in relation to the third State nationals with which the Parties have concluded new readmission agreements after the entry into force of this Agreement.

4. მოთხოვნის წარმდგენი მხარე უკან მიიღებს ნებისმიერ მოთხოვნის მიმღები მხარის მიერ იძულებით გადაცემულ პირს, თუ დადგინდა, რომ არ იქნა დაკმაყოფილებული პირობები ამ მიზნისათვის.
4. The requesting Party shall take back any person reconducted by the requested State if it is established that the conditions thereto have not been met.

2) პირველი პუნქტით გათვალისწინებული იძულებითი გადაცემის ვალდებულება არ მოქმედებს იმ შემთხვევაში, როდესაც მოთხოვნის წარმდგენმა მხარემ მესამე სახელმწიფოს შესაბამის მოქალაქეზე გასცა, მანამდე ან მას შემდეგ რაც ეს პირი შევიდა მის ტერიტორიაზე, ვიზა გარდა ტრანზიტულისა, ან ბინადრობის ნებართვა.
(2) The reconduction obligation set forth in paragraph (1) does not apply in the event that the requesting Party issued to the third State national concerned, before or after that person’s entry into its territory, a visa other than a transit visa, or a residence permit.

3) მოთხოვნის მიმღები მხარე იძულებით გადაცემას დაქვემდებარებული მესამე სახელმწიფოს მოქალაქესთან დაკავშირებით კისრულობს ვალდებულებას შეასრულოს 1951 წლის 28 ივლისის ლტოლვილთა სტატუსის შესახებ კონვენციის 33-ე მუხლის დებულებები, როგორც ეს არის შესწორებული 1967 წლის 31 იანვრის ოქმით ლტოლვილთა სტატუსის შესახებ.
(3) The requested Party undertakes, vis-à-vis the third State national to be reconducted, to comply with the provisions of article 33 of the Convention of 28 July 1951 relating to the Status of Refugees, as amended by the Protocol of 31 January 1967 relating to the Status of Refugees.
