The Regulatory Authority shall have the right to additionally request the provision of permit documentation specified in the Ordinance of the Government of Georgia on Approval of the Rules for Notification and Issuance of Permits for Nuclear and Radiation Activities, in accordance with a differentiated approach.

ბირთვულ მასალასთან ან/და I, II და III კატეგორიების რადიოაქტიურ წყაროებთან დაკავშირებული ბირთვული და რადიაციული საქმიანობის ლიცენზიის გასაცემად, მარეგულირებელი ორგანოს მიერ დაწყებულ ადმინისტრაციულ წარმოებაში საქართველოს შინაგან საქმეთა სამინისტრო მონაწილეობს, როგორც დაინტერესებული ადმინისტრაციული ორგანო, „ლიცენზიებისა და ნებართვების შესახებ“ საქართველოს კანონის შესაბამისად.
The Ministry of Internal Affairs of Georgia shall participate in administrative procedures initiated by the Regulatory Authority for issuing licences for nuclear and radiation activities related to nuclear materials and/or radioactive sources of categories I, II and III, as an interested administrative body in accordance with the Law of Georgia on Licences and Permits.

ა) განმცხადებლის მიერ წარდგენილი განცხადება და თანდართული საბუთები არ აკმაყოფილებს კანონის მოთხოვნებს და მარეგულირებელი ორგანოს მიერ დადგენილ ვადაში განმცხადებლის მიერ არ იქნა გამოსწორებული;
a) the application submitted by an applicant and the attached documents do not comply with the requirements of the Law and have not been corrected by the applicant within the time limit set by the Regulatory Authority;

ბ) განმცხადებელი ვერ აკმაყოფილებს კანონით დადგენილ სარეგისტრაციო, სალიცენზიო ან/და სანებართვო პირობებს;

გ) განმცხადებელს სასამართლოს კანონიერ ძალაში შესული გამამტყუნებელი განაჩენით ჩამორთმეული აქვს შესაბამის სფეროში საქმიანობის უფლება.
c) the applicant is deprived of the right to engage in activities in the relevant field by a legally binding court decision.

მარეგულირებელი ორგანოს გადაწყვეტილება ბირთვული და რადიაციული საქმიანობის რეგისტრაციის, ლიცენზიის ან/და ნებართვის გაცემაზე უარის თქმის შესახებ შეიძლება გასაჩივრდეს ზემდგომ ადმინისტრაციულ ორგანოში − სამინისტროში ან სასამართლოში.
The decision of the Regulatory Authority to refuse registration, issue a licence and/or permit for nuclear and radiation activities may be appealed to a higher administrative body - the Ministry or the court.

ბირთვული და რადიაციული საქმიანობის რეგისტრაციის, ლიცენზიისა და ნებართვის გაცემის შესახებ გადაწყვეტილების მიღების შემთხვევაში, განმცხადებელი უფლებამოსილია სარეგისტრაციო, სალიცენზიო ან სანებართვო მოწმობის მიღებამდე შესაბამისი ადმინისტრაციული აქტის საფუძველზე განახორციელოს რეგისტრაციით, ლიცენზიით ან ნებართვით გათვალისწინებული საქმიანობა.
If a decision is made to register, issue a licence and permit for nuclear and radiation activities, the applicant shall have the right to carry out the activities provided for by the registration, licence or permit on the basis of an appropriate administrative act until receiving a certificate of registration, licence or permit.

მარეგულირებელი ორგანოს მიერ კანონით განსაზღვრულ ვადაში რეგისტრაციის, ლიცენზიის ან ნებართვის გაცემის ან გაცემაზე უარის თქმის შესახებ გადაწყვეტილების მიუღებლობის შემთხვევაში, განმცხადებელს შეუძლია განახორციელოს რეგისტრაციით, ლიცენზიით ან ნებართვით გათვალისწინებული საქმიანობა მხოლოდ სარეგისტრაციო, სალიცენზიო ან სანებართვო მოწმობის მიღების შემდეგ.
If the Regulatory Authority does not take a decision to grant or refuse to grant registration, licence or permit within the time limits prescribed by Law, the applicant may carry out the activities provided for by registration, licence or permit only after receiving a certificate of registration, licence or permit.

რეგისტრაციის, ლიცენზიის ან ნებართვის მფლობელი უფლებამოსილია სარეგისტრაციო, სალიცენზიო ან სანებართვო მოწმობის დაკარგვის ან დაზიანების შემთხვევაში მოწმობის აღდგენამდე შესაბამისი ინდივიდუალური ადმინისტრაციულ-სამართლებრივი აქტის საფუძველზე განახორციელოს რეგისტრაციით, ლიცენზიით ან ნებართვით გათვალისწინებული საქმიანობა.
In case of loss or damage of the certificate of registration, licence or permit, the certificate holder shall have the right to carry out the activities provided for by the registration, licence or permit on the basis of the relevant individual administrative and legal act until the certificate is restored.

The Regulatory Authority shall be obliged to issue an appropriate certificate of registration, licence or permit together with the decision on the satisfaction of an application.

The Regulatory Authority shall monitor the fulfilment of the conditions for registration, licence and permit for nuclear and radiation activities.

კონკრეტულ ბირთვულ და რადიაციულ საქმიანობასთან დაკავშირებული მომეტებული რისკის გათვალისწინებით, მაიონებელი გამოსხივების მავნე ზემოქმედებისაგან ადამიანისა და გარემოს დასაცავად, მარეგულირებელმა ორგანომ შეიძლება მიიღოს რეგისტრაციის, ლიცენზიის ან/და ნებართვის გაუქმების შესახებ გადაწყვეტილება.
Taking into account the increased risk associated with a specific type of nuclear and radiation activities, in order to protect people and the environment from the harmful effects of ionising radiation, the Regulatory Authority may decide to revoke the registration, licence and/or permit.

ბირთვული და რადიაციული საქმიანობის რეგისტრაციის ან ლიცენზიის გაუქმება რეგისტრაციის ან ლიცენზიის მფლობელს არ ათავისუფლებს ვალდებულებისაგან, უზრუნველყოს რადიაციული დაცვა, ბირთვული უსაფრთხოება ან/და დაცულობა, საქართველოს კანონმდებლობის შესაბამისად და მარეგულირებელ ორგანოს დადგენილი წესით წარუდგინოს ინვენტარიზაციის შედეგები და პროფესიული დასხივების დოზების შესახებ მონაცემები.
Cancellation of the registration or licence for nuclear and radiation activities shall not release the holder of the registration or licence from the obligation to provide radiation protection, nuclear safety and/or protection in accordance with the legislation of Georgia and to submit to the Regulatory Authority, in accordance with the established procedure, the results of the inventory and data on occupational exposure doses.

The conditions and procedure for conducting inspections of nuclear and radiation activities shall be determined in accordance with the Order of the Minister on Approval of the Procedure for Conducting Inspections of Nuclear and Radiation Activities.

The Regulatory Authority shall provide support for inspections of nuclear and radiation activities with appropriate financial, technical and human resources.
