At the time of adoption, the adoptive parent shall be entitled to make use of the services of a lawyer or of other authorized legal person as envisaged by the Georgian legislation, and a foreign citizen – in case of absence of any authorized State agency implementing the adoption procedure in his or her respective country – to make use of the services of relevant accredited legal person.

ამ შემთხვევაში ნათესავად ითვლება პირი, რომლისთვისაც გასაშვილებელი ბავშვი არის შვილიშვილი, დისშვილი, ძმისშვილი, გერი ძმის შვილი, გერი დის შვილი, ბიძაშვილი, დეიდაშვილი, მამიდაშვილი ან მათი შვილები.
In this case, the person shall be considered to be a relative, to whom the prospective adoptive child is not a grandchild, a nephew or niece, a stepbrother's child, a stepsister's child, a cousin, or a child of a cousin.

შვილად აყვანის უპირატესი უფლება აქვს საქართველოს მოქალაქეს, საქართველოში მუდმივად მცხოვრებ საქართველოს მოქალაქეობის არმქონე პირს, აგრეთვე უცხო ქვეყნის მოქალაქეს, რომელიც არის გასაშვილებელი ბავშვის ნათესავი ამ მუხლის პირველ პუნქტში აღნიშნულ პირთა წრის ფარგლებში.
The preferential right to adoption shall be enjoyed by a Georgian citizen, a person without the Georgian citizenship permanently resident in Georgia, as well as a foreign citizen, who is a relative of the prospective adoptive child within the scope of the persons set out in paragraph 1 of this Article.

At the time of adoption there must be observed not only the order of sequence existing in the Unified Register, but also the interest of the prospective adoptive child, and due consideration must be given to his or her compatibility with the adoptive family/person.

შვილად აყვანის პროცედურის განმახორციელებელი უფლებამოსილი ორგანოები არიან საქართველოს შრომის, ჯანმრთელობისა და სოციალური დაცვის სამინისტრო ან/და მის სისტემაში შემავალი უფლებამოსილი დაწესებულება (ორგანიზაცია), აფხაზეთისა და აჭარის ავტონომიური რესპუბლიკების შვილად აყვანის სფეროში უფლებამოსილი შესაბამისი სამინისტროები, აგრეთვე მათი ტერიტორიული ორგანოები.
Authorized agencies implementing the adoption procedure shall be the Ministry of Labour, Health and Social Affairs of Georgia or/and an authorized agency (organization) within its system, the relevant Ministries of the Autonomous Republics of Abkhazia and Adjaria having powers in respect of the adoption, and their territorial bodies as well.

Except for the agencies specified in paragraph 1 of this Article and a social worker, any other natural and legal persons shall be prohibited from taking any action with the view of conferring the status of prospective adoptive child and the adoption.

ამავე დროს დაშვებულია შვილად აყვანის დროს საქართველოს კანონმდებლობით გათვალისწინებული ადვოკატის ან სხვა უფლებამოსილი პირის მიერ იურიდიული მომსახურების გაწევა, ხოლო საერთაშორისო გაშვილების დროს – შესაბამის ქვეყანაში შვილად აყვანის პროცედურის განმახორციელებელი უფლებამოსილი სახელმწიფო ორგანოს ან მისი არარსებობის შემთხვევაში – სხვა შესაბამისი აკრედიტებული იურიდიული პირის მიერ მომსახურების გაწევა.
At the same time, in cases of adoption there shall be permitted the provision of legal services by a lawyer or other authorized person provided for by the Georgian legislation, and in cases of intercountry adoption – given the absence of any authorized State agency implementing the adoption procedure in the relevant country – the provision of services by other relevant accredited legal person.
