Under Article 100 (1) (a) the investigator, prosecutor or any official or body conducting the criminal procedure is obliged to summon the interpreter in case, where they do not understand the language spoken by the participant of criminal proceedings (suspect, accused and etc.)

მაშასადამე, საქართველოს სისხლის სამართლის საპროცესო კანონმდებლობა იმპერატიულად მოითხოვს სისხლის სამართლის პროცესში თარჯიმნის ჩართვას, როდესაც: ა) სისხლის სამართლის პროცესის მონაწილემ (ეჭვმიტანილმა, ბრალდებულმა და ა.შ.) არ იცის ოფიციალური ენა; ბ) სისხლის სამართლის პროცესის მწარმოებელ ორგანოს/თანამდებობის პირს (გამომძიებელს, პროკურორს, მოსამართლეს ან სასამართლოს) არ ესმის ენა, რომელზეც სისხლის სამართლის პროცესის მონაწილე საუბრობს.
Therefore, Georgian Criminal Procedural Legislation imperatively requires the involvement of interpreter in criminal proceedings when: a) the participant of criminal proceedings (suspect, accused and etc.) does not know the official language; b) the body/official conducting the criminal proceedings (investigator, prosecutor, judge or the court) do not understand the language spoken by the participant of criminal proceedings.

გარდა ამისა, როდესაც საქართველოს სისხლის სამართლის საპროცესო კანონმდებლობა სისხლის სამართლის პროცესის მონაწილისთვის (ეჭვმიტანილისთვის, ბრალდებულისთვის და ა.შ.) საგამოძიებო და სასამართლო დოკუმენტების გადაცემას მოითხოვს, ყველა ეს დოკუმენტი სავალდებულო წესით უნდა ითარგმნოს ენაზე, რომელიც შესაბამის პირს ესმის (საქართველოს სისხლის სამართლის საპროცესო კოდექსის მუხლი 17(3)).
In addition, where Criminal Procedural legislation of Georgia requires the service of investigative and judicial documents to the participant of the criminal Proceedings (suspect, accused and etc.) all of these documents should compulsorily be translated in a language the person concerned understands (Article 17(3) of the Criminal Procedure Code of Georgia).

ამდენად, იმ ფაქტის გათვალისწინებით, რომ საქართველოს კანონმდებლობა იმპერატიულად მოითხოვს სისხლის სამართლის პროცესში თარჯიმნის ჩართვას, როდესაც სისხლის სამართლის პროცესში მონაწილე პირმა ოფიციალური ენა არ იცის, და ითვალისწინებს სისხლის სამართლის პროცესის მონაწილე ნებისმიერი პირისთვის გადასაცემი ყველა საგამოძიებო და სასამართლო დოკუმენტის სავალდებულო თარგმნას, ადგილი აღარ რჩება ეჭვისათვის, რომ ოფიციალური ენის არასაკმარისი ცოდნა რაიმენაირად ძნელს გახდის ოფიციალური ენის არმცოდნე ან ცუდად მცოდნე ამა თუ იმ პირისთვის დარწმუნდეს, რომ მისი უფლებები არ ირღვევა და სათანადოდაა დაცული დაპატიმრების ან დაკავების შემთხვევაში.
Therefore, taking into account the fact that Georgian Legislation imperatively requires the involvement of an interpreter in criminal proceedings when the person participating in criminal proceedings does not know official language and provides for compulsory translation of all investigative and judicial documents to be served to any participant of criminal proceedings, there is no room to doubt that the lack of knowledge of official language will in any way make difficult for any person having no or poor knowledge of official language to make sure that his/her rights are respected and properly observed in case of arrest or detention.
