The Contracting Parties shall maintain and develop cooperation in the field of protection and exercise of rights to inventions, utility models, industrial designs, trademarks, service marks and appellations of origin, as well as of rights to subjects of copyright law and of neighbouring rights, on the basis of mutual benefit, equality and the national legislations of the Contracting Parties, in accordance with the provisions of the present Agreement and those of other international treaties, to which the States Parties are, or may become the Parties.

11.2.ხელშემკვრელ მხარეთა თანამშრომლობა მიმართული იქნება: ა) ინტელექტუალური საკუთრების დაცვის ობიექტებზე უფლებების დაცვასა და გამოყენებასთან დაკავშირებული საკითხების რეგულირებისაკენ; ბ) მხარეთა სახელმწიფო ტერიტორიებზე წარმოშობილი საქონლის გეოგრაფიული აღნიშვნების (ადგილწარმოშობის დასახელებების) ურთიერთ აღიარებასა და დაცვისაკენ; გ) ინტელექტუალური საკუთრების დაცვის სფეროში ინფორმაციის, ნორმატიული აქტების და სხვა დოკუმენტების, აგრეთვე გამოცდილებისა და სპეციალისტების გაცვლისაკენ; დ) ინტელექტუალური საკუთრების უფლებათა დაცვის შესახებ საერთაშორისო მრავალმხრივ ხელშეკრულებებში თითოეული ხელშემკვრელი მხარის მონაწილეობის, ასევე ხელშეკრულებებთან დაკავშირებული ვალდებულებების შესრულებასთან დაკავშირებით გამოცდილებისა და ინფორმაციის გაცვლისაკენ; ე) ხელშემკვრელ მხარეთა შორის შეთანხმებული თანამშრომლობის სხვა ფორმებზე.
The aims of cooperation between the Contracting Parties shall be as follows: a) The regulation of issues relating to the protection and exercise of rights to the subjects of protection of intellectual property; b) Mutual recognition and protection of the geographical designations (appellations of origin) of the goods, originating in the respective national territories of the Parties; c) The exchange of information, legal acts and other instruments concerning the protection of intellectual property, as well as the exchange of experience and specialists; d) The exchange of experience and information related to the participation of each of the Contracting Parties in international multilateral agreements on the protection of intellectual property rights, as well as to the fulfilment of the obligations arising from those agreements; e) The development of other forms of cooperation agreed upon between the Contracting Parties.

The Contracting Parties shall develop cooperation in the field of protection of intellectual property rights, in accordance with the provisions of international conventions and agreements of international organizations, in particular, the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).

The Contracting Parties shall provide conditions for the liberalization of their already functioning markets of services and shall, on the basis of reciprocity, aim at gradual elimination of restrictions in order to create conditions for unimpeded provision of services within the area of free trade regime.

The Contracting Parties shall determine the kinds of services to which the provisions of the present Article apply, identifying priority services within the framework of immediate service of goods turnover, in respect of which the issues of liberalization of import and export must be addressed in the first place.

General Exceptions. The present Agreement is without prejudice to the right of any of the Contracting Parties, to take the internationally recognized measures of Government regulation in the field of foreign economic relations, which it deems necessary in order to protect its essential interests and which are undoubtedly necessary for the implementation of the international agreements, to which it is, or intends to become a Party, subject to the condition, however, that such measures are not applied in an arbitrary and discriminatory manner, and relate to: a) The protection of public morality and public security; b) The protection of human life and health; c) The protection of animals and plants; d) The protection of environment; e) The protection of national treasures, possessing artistic, archaeological and historic value; f) The protection of industrial and intellectual property; g) Trade in gold, silver, or other precious metals and gems; h) The preservation of exhaustible natural resources; i) Balance of payments difficulties; j) Restrictions concerning the exports of products, where the domestic price of such products are kept below the world price as part of Governmental support programme.

წინამდებარე შეთანხმება არ ეწინააღმდეგება არცერთი ხელშემკვრელი მხარის უფლებას განახორციელოს სახელმწიფო რეგულირების ნებისმიერი ზომები, რასაც ის ჩათვლის საჭიროდ, თუ ეს ზომები ეხება: ა) მოქმედი უსაფრთხოების უზრუნველყოფას, იმ კონფიდენციალური ინფორმაციის ჩათვლით, რომელიც ითვლება სახელმწიფო საიდუმლოდ; ბ) იარაღით, სამხედრო ტექნიკით, საბრძოლო მასალებით ვაჭრობას, სამხედრო ხასიათის მომსახურების გაწევას, ტექნოლოგიების გადაცემას და შეიარაღებისა და სამხედრო ტექნიკის წარმოებისა და სხვა სამხედრო მიზნებით მომსახურების გაწევას; გ) ხლეჩადი მასალებისა და რადიოაქტიური ნივთიერებების წყაროების მიწოდებას, რადიოაქტიური ნარჩენების უტილიზაციას; დ) ომის დროს ან საერთაშორისო ურთიერთობაში სხვა საგანგებო გარემოებებისას განხორციელებულ ღონისძიებებს; ე) საერთაშორისო მშვიდობისა და უშიშროების შესანარჩუნებლად გაეროს წესდების საფუძველზე მის მიერ ნაკისრ ვალდებულებათა შესრულებას.
The present Agreement shall be without prejudice to the right of any of the Contracting Parties, to adopt such measures of Government regulation, as it deems necessary, if these measures relate to: a) The protection of national security, including the confidential information which is considered to constitute a State secret; b) Trade in arms, military hardware and ammunition, provision of services of military nature, transfer of technologies and production of armaments and military hardware, and provision of services for other military purposes; c) Supplies of fissionable materials and sources of radioactive substances, disposal of radioactive waste; d) Measures adopted in time of war or other emergencies in international relations; e) The fulfilment of its obligations under the Charter of the United Nations undertaken for the maintenance of international peace and security.

ხელშემკვრელი მხარეები იმპორტის მიმართ ანტიდემპინგური კომპენსაციური და სპეციალური ღონისძიებების გამოყენებისას იხელმძღვანელებენ ტარიფებისა და ვაჭრობის შესახებ გენერალური შეთანხმების (GATT/WTO-ს) პრინციპებითა და დებულებებით.
In application of antidumping and countervailing measures in respect of imports, the Contracting Parties shall be guided by the principles and provisions of the General Agreement on Tariffs and Trade (GATT/WTO).

ნებისმიერი დავა და უთანხმოება ხელშემკვრელ მხარეთა შორის წინამდებარე შეთანხმების დებულებათა განმარტების და/ან გამოყენების თაობაზე, აგრეთვე სხვა დავა, რომელიც შეეხება ხელშემკვრელ მხარეთა უფლება-მოვალეობებს წინამდებარე შეთანხმების შესაბამისად ან მასთან დაკავშირებით, გადაწყდება შემდეგი წესით: ა) ხელშემკვრელ მხარეთა შორის მოლაპარაკებებისა და კონსულტაციების გზით; ბ) სპეციალური შეთანხმებული პროცედურის ფარგლებში (სადავო მასალების შესასწავლად და რეკომენდაციების შესამუშავებლად სამუშაო ჯგუფების შექმნის გზით).
Any dispute or controversy between the Contracting Parties arising from the interpretation and/or application of the present Agreement, as well as any other dispute, concerning rights and obligations of the Contracting Parties under the present Agreement, shall be settled as follows:a) By means of negotiations and consultations between the Contracting Parties; b) Within the procedure, specially agreed upon (by means of establishing working groups in order to examine the matters of dispute and to make recommendations).

If any dispute arising between the Parties cannot be settled in accordance with the procedures laid down in paragraph 1 of this Article, the Parties shall be entitled to apply the legal provisions established under international law.
