მოცემულ შემთხვევაში პირადი მონაცემების დამუშავება რეგულირდება საქართველოს კანონმდებლობით, იმ შემთხვევაში თუ ეს ხორციელდება ბენელუქსის სახელმწიფოს კომპეტენტური ორგანოს მიერ, 1995 წლის 24 ოქტომბრის პირადი მონაცემების დამუშავებასთან დაკავშირებით პირთა დაცვის და ამგვარი მონაცემების თავისუფალი გადაადგილების შესახებ 95/46/EC დირექტივის დებულებებით და ამ დირექტივის საფუძველზე შემუშავებული მოქმედი კანონმდებლობის შესაბამისად.

The processing and handling of personal data in a given case are subject to the laws of Georgia and, if the handling is done by a competent authority of a State of the Benelux, to the provisions of Directive 95/46/EC of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the national legislation established on the basis of this Directive.

2. personal data must be obtained for the specific, explicitly defined and justified objective of implementing this Agreement and may not be processed further by the communicating or receiving authority in any way that is incompatible with that objective;

6. აუცილებლობის შემთხვევაში გამგზავნმა და მიმღებმა ორგანოებმა უნდა მიიღონ ყველა საჭირო ზომა, რათა უზრუნველყოფილ იქნას პირადი მონაცემების გასწორება, განადგურება ან დამალვა, თუ მონაცემთა დამუშავება არ მიმდინარეობს წინამდებარე მუხლის დებულებების შესაბამისად, კერძოდ, თუ დამუშავების მიზნებიდან გამომდინარე, ეს მონაცემები არის არასათანადო, შეუფერებელი, არაზუსტი ან გადაჭარბებული.

6. the communicating and the receiving authorities shall take all appropriate measures to ensure, where necessary, the correction, deletion or masking of personal data when the processing is not in accordance with the provisions of this article, in particular because the data are inappropriate, irrelevant, inaccurate or excessive in relation to the objective of the processing.
